Challenges in registration of 3D and Pattern MarksA recent seminar hosted by Keltie highlighted the difficulty of registering shape and pattern marks based on inherent distinctiveness, as well as (for EU trade marks) the challenge of proving acquired distinctiveness through use throughout the EU. To be accepted for registration as inherently distinctive, a shape must diverge significantly from the norms and customs of the sector concerned and be capable of functioning as an indicator of origin. During the seminar, Keltie’s trademark attorneys discussed five recent EU and UK cases that illustrate how this test is applied in practice, while guest speaker Andrea De Gaspari of De Gaspari Osgnach in Padua (Italy) explained the Italian, EU and US proceedings in the MOON BOOT case.

He joins the firm from Wynne-Jones and brings with him over ten years’ experience in IP. Having completed a law degree in 2011, Jason wanted to build on his already keen interest in business and branding from a consumer perspective. He found his niche in trade marks and began his career as a paralegal before going on to complete his trade mark attorney qualifications.
