Before these troubled times, OHIM’s success led to a huge cash surplus; recently, however, CTM filings have been falling. OHIM will therefore reduce its CTM fees from 1 May 2009. Typical fee reductions will be around 40%: for example, the fee for a three-class electronically-filed CTM application will fall from EUR 1600 now to just EUR 900. Also, the reduced fee will be payable only upon filing rather than being divided between the filing and registration stages as now.
OHIM’s basic fee for CTM applications designated via the Madrid Protocol will reduce from EUR 1450 to EUR 870.
There will be no change to OHIM’s fee for each additional class, namely EUR 150 per class over three, payable upon filing or upon designation.
Applicants will welcome the lower cost and the streamlining of the CTM process.
