About Manuela

Manuela's substantial trade mark practice ranges from clearance searches and prosecution, due diligence projects, oppositions and other contentious matters, negotiations and IP focussed contracts. She manages a significant number of worldwide trade mark portfolios being responsible for their overall strategy. Her client base and experience cover a broad spectrum of industries, but in particular, sports, pharmaceuticals and fashion.

Designs and domain name/online brand enforcement matters have become an increasingly important part of Manuela’s practice in recent years with Manuela advising high profile brands on tackling online infringement and assisting them on devising and implementing design protection strategies.

 

In 2013 Manuela founded Keltie's Sports Trade Mark Practice, which she heads. Manuela brings to this practice a wealth of experience built over the years in representing and advising trade mark owners in the sports sector. Her involvement with sports clients almost on a daily basis has enabled Manuela to develop a specific sensitivity for issues relevant to this industry, which informs her approach to advising sports clients.

Manuela is frequently invited to present at International conferences. Her many speaking engagements include a presentation to INTA Europe in Madrid in February 2020.

 

Manuela has been educated in Switzerland and Italy and she is conversant in a number of European languages (Italian, French, German). In 2005, she qualified in the UK as Chartered Trade Mark Attorney. She is also a European Trade Mark Attorney and a Member of the Chartered Institute of Trade Mark Attorneys (‘CITMA’) and has been a Partner of Keltie since 2011.

Challenges in registration of 3D and Pattern Marks

A recent seminar hosted by Keltie highlighted the difficulty of registering shape and pattern marks based on inherent distinctiveness, as well as (for EU trade marks) the challenge of proving acquired distinctiveness through use throughout the EU. To be accepted for registration as inherently distinctive, a shape must diverge significantly from the norms and customs of the sector concerned and be capable of functioning as an indicator of origin. During the seminar, Keltie’s trademark attorneys discussed five recent EU and UK cases that illustrate how this test is applied in practice, while guest speaker Andrea De Gaspari of De Gaspari Osgnach in Padua (Italy) explained the Italian, EU and US proceedings in the MOON BOOT case.
